Case No.350/12, arising out of Complaint Case No.679/2011, for the offence punishable under Sections- 232, 341, 406, 409, 420, 504 and 120B of I.P.C. read with Sections-3/4 of SC/ST (Prevention of Atrocities) Act.
The petitioner filed A.B.P. No.560 of 2012 in the Court of learned Addl. District & Sessions Judge, Kishanganj, which was dismissed through order dated 29.11.2013.
This application is filed under Section-438 of Cr.P.C. with a prayer to grant anticipatory bail in connection with Complaint Case No.679/2011 on the file of Chief Judicial Magistrate, Kishanganj.
Patna High Court Cr.Misc. No.33040 of 2014 (2) dt.04-02-2015 2/2 Heard learned counsel for the petitioner and learned APP for the State.
One Mr. Upendra Ram submitted a complaint on 4.7.2011 against the petitioner, alleging that the petitioner, who is also associated with the administration of MGNREGA, is not paying the wages to the workers and when the complainant insisted on the payment, he was abused with reference to his caste name. It is brought to the notice of the Court that two other accused have been granted regular bail.
This Court is convinced that the petitioner deserves to be granted anticipatory bail. The application is allowed.
In the event of the arrest or surrender of the petitioner, he shall be released on bail on furnishing the bail-bond of Rs.10,000/- (ten thousand) along with two sureties of the like amount each to the satisfaction of Chief Judical Magistrate, Kishanganj in connection with Kishanganj P.S.
