====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 05-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 21.3.2018, seeks bail in Dumariyaghat PS Case No. 20 of 2018 registered under Sections 447, 341, 323, 307, 379, 504 and 506/34 of the IPC. The allegation in brief is that due to grazing of crop by the cattle in the field both sides had earlier quarrel, the accused persons turned up and Sri Ram Yadav gave iron rod blow on the head of the informant's son and this petitioner is alleged to have given lathi blow over head of the informant.

Learned Counsel for the petitioner submits that the injury caused to Sandeep Kumar is grievous but there is no injury on the person of the informant and the petitioner has not assaulted Sandeep Kumar and he also bears no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Awadh Kishore Yadav @ Awadh Kishore Rai is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM lst, East Champaran, Motihari in connection with Dumariyaghat PS Case No. 20 of 2018.
