5. The factum of compromise and receipt of payment has been duly accepted by the O.P. No. 2, is the contention of learned Advocate for the O.P. No. 2.
6. Considering the allegation levelled in the complaint case which, prima facie, appears to be a money transaction and a dispute arising therefrom, this Court had appointed an Arbitrator and now both the parties have compromised their dispute. None of the parties have any complaint to each other. Moreover, the learned jurisdictional Court has taken cognizance of the offences under Sections 420 and 406 of the Indian Penal Code.
7. Trite it is, the criminal cases having overwhelmingly and predominantly civil character, particularly those arising out of commercial transactions or arising out of matrimonial relationship or family disputes should be quashed. When the parties have resolved their entire disputes among themselves; it warrants to secure the ends of justice or to prevent abuse of the process of any Court.
8. In view of the aforesaid facts, this Court finds that
4/4 now continuance of the proceeding at the face of the settlement between the parties would be an abuse of the process of the Court and accordingly, the order taking cognizance dated 29.11.2017 passed in Complaint Case No. 1643/C/2016 by the learned Additional Chief Judicial Magistrate IIIrd, Bhagalpur stands quashed to the extent it relates to the petitioners.
9. Both the quashing applications stand allowed. (Harish Kumar, J) shivank/- U T
