This appeal has been preferred against the order dated 17.02.2020 passed by learned 3rd Additional Sessions Judgecum-Special Judge, SC & ST Act, Bhagalpur in G.R. No. 131 of 2019 arising out of Sabour (Goradih) P.S. Case No. 258 of 2019 instituted for offence under Sections 376, 420, 328, 504 and 34 of the Indian Penal Code and Sections 3(i)(R)(E) and 3(2)(va) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act whereby the prayer of the appellant for regular bail has been rejected.
Patna High Court CR. APP (SJ) No.1013 of 2020(4) dt.06-10-2020 2/2 Learned counsel appearing on behalf of the appellant would submit that the appellant has no criminal antecedent and he is in custody since 29.01.2020.
Having regard to the nature of allegations levelled against the appellant in the present case and materials available on record, the Court is not inclined to grant bail to him. The appeal is dismissed.
However, the trial court is directed to expedite the trial and conclude the same within a period of nine months from today.
