Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Parsa Bazar P.S. Case No. 393 of 2020 registered under Section 341, 323, 498(A),494, 34 of Indian Penal Code and 3⁄4 Dowry Prohibition Act.

Allegedly this petitioner and his family members physically and mentally tortured the informant for the demand of a motorcycle.

The main submissions advanced by learned counsel for the petitioner are that the petitioner has been languishing in

No.17419 of 2022( 2) dt.07-07-2022 2/2 jail for last 7 months, in fact the petitioner was residing at her Sasural with the informant and thereafter a dispute arose between him and informant and then, at the instance of husband of informant's sister, the present case was lodged and in actual the petitioner himself is a victim of the behaviour and conduct of his wife.

Learned APP for the State has opposed the bail prayer. Having regard to the facts and circumstances of this case and considering above submissions and mainly the petitioner's custody period and also the fact that marriage of the informant with this petitioner took place in the year 2015 and alleged offences are triable by first class Magistrate, in my view a lenient approach can be taken in respect of petitioner's prayer let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in Connection with Parsa Bazar P.S. Case No. 393 of 2020.
