JUSTICE SANJAY KUMAR ORAL ORDER 30-10-2017 Learned counsel for the petitioners submits that petitioner no.1 has already been arrested and so he does not press his prayer of anticipatory bail.

The application for anticipatory bail on behalf of the petitioner no.1 is, accordingly, dismissed as withdrawn. Heard learned counsel for the petitioner no.2 and learned A.P.P. for the State.

The allegation of assault by iron rod causing injury on the head of the mother of the informant is against Rajnandan Yadav. This petitioner allegedly attempted to outrage modesty of one of the family members of the informant.

It has been submitted by the learned counsel for the petitioners that the informant and the petitioners are agnates and there is counter case also from the side of the petitioners.

Patna High Court Cr.Misc. No.50378 of 2017 (2) dt.30-10-2017 2/2 Considering the nature of allegation, facts and circumstances of the case, let the petitioner no.2, named above, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the S.D.J.M., Jehanabad, in Makhdumpur P.S. Case No.50 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
