The petitioner is in custody in connection with Hisua P.S. Case No. 257 of 2016 for the offence under Section 302 of the Indian Penal Code and Section 27 of the Arms Act. In this case, case diary was called for.
From perusal of the case diary, it appears that at one point of time, the matter was supervised by the DIG and on consideration of the photographs available at the time of the alleged occurrence, the DIG was of the considered view that someone else committed murder of the deceased and this petitioner is innocent. It also appears from the case diary that the petitioner has been a bright career and selected as an engineer in Railway.
Learned counsel for the petitioner submits that there is no eye witness to the occurrence and because of firing, the

No.18918 of 2020(3) dt.07-07-2020 2/2 people gathered there tried to flee away from the place of occurrence, therefore, somebody has suspected involvement of this petitioner. He further submits that the petitioner has got no criminal antecedent and he is in custody since 27.11.2019. Considering the materials available on record, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate-Sub-Judge-II-cum 1st A.S.J., Nawada in connection with Hisua P.S. Case No. 257 of 2016 with the condition that both the bailors should be the family members of the petitioner.
