1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Buniyadganj P.S. Case no. 309 of 2023 registered under sections 307, 147, 148, 149, 323, 325, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, the informant states that the five named accused persons came variously armed. Tinku Kumar assaulted the informant on his head with an iron rod while Dilip Kumar and Navin Kumar assaulted with lathi. It is further stated that the other accused persons including the petitioner reached there and assaulted the informant and others .

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The

Referring to the order of the learned trial Court it is submitted that all the injuries of the injured on the vital part of the body have been found to be simple in nature. The petitioner is in custody since 24.12.2023 and has no criminal antecedent.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., injuries on the vital part of the body having been found to be simple in nature together with the petitioner having remained in custody for 6 months since 24.12.2023 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Buniyadganj P.S. Case no. 309 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gaya.
