2. State counsel accept notice for respondents.

3. In the instant petition, petitioner has sought for following reliefs:

"1) That, the present writ application is being filed for issuance of an appropriate writ/writs, order/orders, direction/directions for the following reliefs:- (i) For issuance of an appropriate writ in quashing the order dated 28.05.2011 vide P-8/25/10.168 passed by Commandant 168 Battalion C.R.P.F. Bijapur, Chattisgarh whereby and where under the petitioner has been dismissed from service contained in Annexure 4.

Patna High Court CWJC No.8835 of 2021 dt.15-02-2022 2/2 (ii) For issuance of an appropriate writ commanding the Respondents to reinstate the petitioner to the post of Constable in the 168 C.R.P.F. Battalion with all consequential benefit.

(iii) For any other relief or reliefs for which the petitioner is entitled under law as well as on the facts of the case."

4. Petitioner has statutory remedy of appeal before the appellate authority.

5. Accordingly, the present petition stands disposed of reserving liberty to the petitioner to prefer appeal before the appellate authority within a period of eight weeks from the date of receipt of this order. If such appeal is filed, the appellate authority is hereby directed to examine condonation of delay in presenting the appeal with reference to Annexure-2 series. If the petitioner satisfies delay in submission of appeal, thereafter, the appellate authority is hereby directed to decide the petitioner's appeal on merit. The above exercise shall be completed within a period of three months from the date of receipt of petitioner's appeal.
