JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 09-08-2019 In the impugned order dated 20.02.2018, the learned 12th Additional Sessions Judge has recorded that at that point of time nine witnesses have already been examined on behalf of the prosecution and all the witnesses have supported the prosecution case. The case was pending for examination of doctor of S.K.M.C.H., Muzaffarpur for which reminder letter was issued to the Superintendent.

This bail application seems to have been filed after about 13 months from the date of rejection of the bail by the court below. There is no disclosure as to what happened between 13 months period.

Considering the facts and circumstances of the case wherein it is the observation of the learned Additional Sessions

Patna High Court CR. MISC. No.20771 of 2019(2) dt.09-08-2019 2/2 Judge that nine prosecution witnesses have supported the case of the prosecution and the case was pending only for examination of the doctor, I find no reason to pass any order in the present application for grant of bail. If the trial has not concluded as yet, let it be concluded and it will be responsibility of the Superintendent of Police, East Champaran at Motihari to ensure presence of the doctor if he has not appeared in the trial so far.
