2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 363, 366(A), 380 and 34 of the IPC in connection with Chandramandih P.S.Case No. 74 of 2024.
3. As per the allegation, the petitioner enticed away the daughter of the informant for the purpose of marriage.
4. The learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner and the daughter of the informant both are adults and their love and affection bloomed to such an extent that they performed marriage out of their sweet will.
5. Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.16956 of 2026(2) dt.25-03-2026 2/3 anticipatory bail of the petitioner.
6. Considering the fact that the petitioner and the daughter of the informant were in love affairs and out of the wedlock, they are blessed with a baby that itself indicates that the informant's daughter is happily and voluntarily living with the petitioner. Under these circumstances, I am inclined to grant the privilege of anticipatory bail to the petitioner.
7. Let the petitioner, as named above, in the event of his arrest or surrender within four weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Jamui in connection with Chandramandih P.S.Case No. 74 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and subject to further condition that :- (i) the petitioner shall co-operate in the investigation/ trial.
(ii) the learned Court would, however, verify the criminal antecedent of the petitioner and in case it is found that the petitioner has concealed his criminal antecedent, the Court
