The petitioner seeks bail in a case registered under Sections 302, 379 of the Indian Penal Code.

Allegation is that the accused persons assaulted the grand father of the informant and co-accused Bablu Singh assaulted with knife at the chest of the informant's grand father, due to which he fell down and in course of treatment he died. It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.01.2020 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The allegation of assault is alleged against the co-accused, namely, Bablu Singh. No injury is attributed

Patna High Court CR. MISC. No.15405 of 2020(2) dt.03-03-2020 2/2 against the petitioner causing upon the deceased. At best an offence under Section 379 of I.P.C. is attributed against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XII, Saran at Chapra in connection with Bheldi P.S. case No.379 of 2019.
