The petitioner is languishing in custody in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

It is alleged that cash of Rs. 90,700/-, ATM card, mobile, Aadhar Card, Cheque Book etc which was kept in purse of the informant was robbed by two unknown motorcycle borne criminals.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The F.I.R is against

Patna High Court CR. MISC. No.17393 of 2023(2) dt.16-05-2023 2/2 unknown. The petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has been remanded in this case from Paroo P.S. Case No. 77 of 2022 only on the basis of suspicion. The petitioner is languishing in custody since 26.02.2022.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned 20th Additional Sessions Judge, Muzaffarpur in connection with Paroo P.S. Case No. 507 of 2021 (Sessions Trial No. 49 of 2023).
