JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-05-2016 Petitioners are apprehending their arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 420, 468 of the Indian Penal Code.
The prosecution case is that the petitioners being daughter and son-in-law of the complainant got her land transferred by cheating her.
It appears from the impugned order that learned Additional Sessions Judge, II, Patna has disposed of the bail anticipatory application of the petitioners since summons have been issued. This fact has not been controverted by learned counsel appearing on behalf of the petitioners.
In view of the ratio laid down in the case of Salim Ansare @ Md. Salim Ansare and Others Vs. The State
Patna High Court Cr.Misc. No.23174 of 2016 (2) dt.24-05-2016 2/2 of Bihar & Another reported in 2015(3) PLJR, 806(Cr. Misc. No. 51075 of 2014), let learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Complaint Case No. 19(C) of 2015, pending in the Court of learned Sub-Divisional Judicial Magistrate, Masaurih. With the observations above, the application stands disposed off.
