====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 20-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Danapur P.S. Case No. 356 of 2021 lodged under Sections 364/120B/34 of the Indian Penal Code.
As per the F.I.R., the informant disclosed that his younger brother went from the house at 7.30 pm on 16.05.2021, intimating that he is going for singing and thereafter did not come back. The informant has suspicion that the petitioner and her husband had provided loan by the brother of the informant and on demanded to return the money, they have put pressure on series of occasions as well as threatened to him and thereafter his brother became traceless as such the informant has every faith about killing of his brother by the petitioner and other

Learned counsel for the petitioner submits that from the statement of F.I.R. itself it transpires that there is no eyewitness and present case has filed on suspicion only. He further submits that petitioner is a lady having two kids aged about 6 years and 3 years. She is in custody since 23.05.2021 and charge sheet has already been filed in this case. Learned counsel for the petitioner further submits that she is ready to support during trial and ready to undertake that on every date she shall appear physically before the lower court.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-V, Danapur in connection with Sessions Trial No.571 of 2021 arising out of Danapur P.S. Case No. 356 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
The petitioner is directed to appear before the lower Court on each and every date, in case of non-appearance for two
Patna High Court CR. MISC. No.18576 of 2022(2) dt.20-07-2022 3/3 consecutive dates, shall resulted into cancellation of her bail bond.
