JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Shahpur P.S. Case No. 34 of 2015 registered for the offence under Section-406 of the Indian Penal Code.

The contention on behalf of the petitioner is that the petitioner distributed the amount, in question among the beneficiaries and some amount was deposited with the bank. It is also pointed out that supplementary affidavit has been filed on behalf of the petitioner on 19-05-2015 and in the said supplementary affidavit, the documents have been annexed but the same has not been placed on record.

Patna High Court Cr.Misc. No.12149 of 2015 (4) dt.21-05-2015 2/2 Learned counsel, appearing for the petitioner placed second copy of supplementary affidavit before me. Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Shahpur P.S. Case No. 34 of 2015 to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara subject to conditions as laid down u/S 438(2) of the Cr. P.C.

The office should keep the supplementary affidavit, filed on behalf of the petitioner on record.
