Counsel for the petitioner submits that against the order of conviction passed in the criminal proceeding arising out of Vigilance P.S. case no. 17/1987, petitioner has preferred criminal appeal which is pending consideration before the High Court.

Claim of the petitioner for grant of ACP has been rejected. Charge sheet had been submitted in the said proceeding on 20.08.1990. Petitioner became eligible as per petitioner's claim for grant of benefits under the ACP scheme with effect from 09.08.1999.
