The petitioner is in custody since 25.5.2018 in connection with G.O. Case No. 90 of 2018 registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody in this case since 25.5.2018. Learned counsel for the petitioner further submits that similar circumstance co-accused Mithu Kumar @ Nivash Kumar has been granted bail by Co-ordinate Bench of this Court in Cr. Misc. No. 24911 of 2018 vide order dated 01.05.2018.
Patna High Court Cr.Misc. No.38939 of 2018(2) dt.09-07-2018 2/2 Considering the fact that the other co-accused has been granted bail by Co-ordinate Bench of this Court, let the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned A.D.J.-II- Cum- Special Judge Excise Act, Sitamarhi in connection with G.O. Case No. 90 of 2018.
