1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Ara Town P.S. Case No. 329 of 2021 registered for the offences punishable under Sections 323, 504, 506, 307, 379 and 34 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that he was returning from a marriage when he saw the accused persons drinking, on which he objected, thereafter Jai assaulted him by butt of pistol causing injury on head, thereafter petitioner assaulted by rod on his back and leg while Mani snatched chain worth Rs. 10,000/-,

Patna High Court CR. MISC. No.18241 of 2025(3) dt.23-07-2025 2/3 further Rahul and his father indulged in illegal liquor trade, it is also alleged that earlier the accused had demanded extortion of Rs. 50,000/-.

Learned counsel for the petitioner next submits that petitioner is alleged to have assaulted the informant by rod on his back and leg i.e. not on vital part of the body when allegation of assaulting on head is against Jai by butt of pistol who has been granted the privilege of anticipatory bail by a learned Coordinate Bench of this Court by an order dated 10.01.2023 in Criminal Miscellaneous No. 50262 of 2022.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that petitioner has not approached this Court with clean hands, it is next submitted that at Para-125 of the case diary, two criminal antecedents of the petitioner are mentioned, it is next submitted that the case is of the year 2021 and the petitioner at his leisure in the year 2025 has approached this Court seeking anticipatory bail. It is also submitted that even the injury suffered by the injured is grievous in nature and Jai Kumar was granted the privilege of anticipatory bail on the ground that the injury report was not recorded in the order impugned.

6. Considering the submissions made by the learned

Patna High Court CR. MISC. No.18241 of 2025(3) dt.23-07-2025 3/3 APP for the State, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.

7. Accordingly, the instant anticipatory bail application is rejected.
