The petitioners are in custody in connection with Madhepura P.S. Case No. 27 of 2017 for the offences punishable under Sections 307 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.

Mr. Viveka Nand Singh, learned counsel for the petitioners submits that there is land dispute between the petitioners and the informant. On account of land dispute there was altercation and both the sides sustained injuries. There is case and counter case and he refer to Annexure-3 to substantiate his argument that counter case was filed against the informant by the

Patna High Court Cr.Misc. No.44311 of 2017 (2) dt.21-09-2017 petitioners' side. He has also submitted that the petitioners are men of clean antecedent.

Having regard to the fact that there was case and counter case on account of land dispute, both the sides have sustained injuries and as per the doctor the injuries were simple, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in Madhepura P.S. Case No. 27 of 2017, subject to the conditions that the bailors should be the family members of the petitioners, the petitioners will extend full cooperation in conclusion of trial and will not tamper with the evidence or influence the witnesses.
