Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with Gaurichak P.S. Case No. 429 of 2020 registered for the offences punishable under Sections 341/323/325/308/379 of the Indian Penal Code.

Considering the allegations levelled against the petitioners and the fact that there is a case under Section 302 of

Patna High Court CR. MISC. No.27438 of 2021(4) dt.16-05-2022 2/2 the Indian Penal Code between the parties and this case arises out of a civil dispute and also ingredients of Section 308 are missing, the present anticipatory bail application is allowed. Accordingly, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VIth Patna City, Patna, in connection with Gaurichak P.S. Case No. 429 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

Counter affidavit filed on behalf of the opposite party No. 2 is taken on record.
