JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302 and 328/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant by administering poison by the husband of the victim and the petitioner with whom the husband of the victim had illicit relationship.
It is submitted by learned counsel for the petitioner that the postmortem report does not reflect any external or internal injury particularly resisting injury and the viscera has been preserved. The husband of the victim has been chargesheeted under Section 306 of the IPC, hence on suspicion, the accusation has been levelled.

No.25026 of 2015 (2) dt.30-06-2015 2/2 Considering the fact that the thrust of accusation is against the husband of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda at Biharsharif in connection with Rahui P.S. Case No. 293 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
The bail bond of the petitioner will be accepted on filing of the affidavit by the petitioner before the learned court below to the effect that she will regularly co-operates in the investigation. Non-co-operation in the investigation by the petitioner will give liberty to the learned court below to cancel the bail bonds of the petitioner.
