ANJANA MISHRA ORAL ORDER 25-07-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Mahila Thana Motihari P.S. Case No. 98 of 2015 for the offences registered under Sections 311, 323, 342, 504, 376, 420/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that actually the victim lady is a married women, who had filed the matrimonial case against her husband namely, Md. Meraj. It was only because of the fact that the petitioner refused to marry with the informant that the present allegations have been made against the petitioner.

No.22303 of 2016 (4) dt.25-07-2016 surfaced in the record, it appears that the victim lady has tried to implicate the petitioner for the reasons best known to herself and also the fact that the petitioner has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari in connection with Mahila Thana Motihari P.S. Case No. 98 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
