The petitioner apprehends his arrest in connection with Excise Case No. 198 of 2018 (Excise Case No.1715 of 2018) registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel appearing on behalf of the petitioner has submitted that there is no recovery from the conscious possession of the petitioner, but in paragraph-3 of the bail petition, the petitioner has been made accused in two cases bearing Madhepura (Parmanandpur P.S. Case No. 95 of 2018 for the offences punishable under Sections 341, 323, 427, 447, 435, 307, 379, 354(A), 504, 34 of the Indian Penal Code and

Patna High Court CR. MISC. No.33089 of 2019(3) dt.23-08-2019 2/2 Madhepura (Ghailarh) P.S. Case No. 535 of 2018 for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail is hereby rejected. However, the court below is directed to consider and dispose of the case on the same date.
