This is an application for bail in connection with Nabinagar P.S.Case No. 133 of 2017 registered for the offences punishable under Sections 304B and 34 of the Indian Penal Code. Allegation is of dowry death and petitioner is said to be husband of deceased.

Submission of learned counsel for the petitioner is that she became ill and cause of death could not be ascertained. Further submission is that he informed her family members about her death and he has falsely been implicated in this case and he is in custody since 26.5.2017.

Heard learned APP also, who has opposed the prayer for bail stating that death took place within one year of marriage and further there are many injuries on the person of deceased and there

Patna High Court Cr.Misc. No.49517 of 2017 (3) dt.17-11-2017 2/2 is allegation of demand and cruelty.

Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner. However, when materials will come, the petitioner may renew his prayer for bail before the court below. (Vinod Kumar Sinha, J) spal/- U
