JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-06-2019 This application, for grant of anticipatory bail, arises out of Shambhuganj P.S. Case No. 213/18, disclosing offences under Sections 341, 323, 325, 307, 354, 504/34 of the Indian Penal Code.
Allegation against the petitioners and others is that they entered inside the house and thrashed the son of informant into a drainage and when the her mother came to save her, she was also pushed into drainage and was assaulted on her head and also assaulted on her on her hand causing fracture injury. Submission of learned counsel for the petitioners is that both the parties are gotias and the dispute arose between them with respect to drainage. Further submission is that all the

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Shambhuganj P.S. Case No. 213/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
