JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 06-07-2020 Heard the parties through the virtual court proceeding. The petitioner apprehends his arrest in connection with Sultanganj P.S. Case No. 356 of 2019 registered for the offences punishable under Sections 379, 511, 414, 34 of the Indian Penal Code.

Allegation against the petitioner is that he along with other co-accused persons dishonestly received stolen battery from the ATM machine.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that no offence has been made out against the petitioner. Learned A.P.P. for the State has opposed the prayer for bail and submits that from the impugned order, it is clear that seven stolen battery have been received from junk dealer shop

In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner in connection with Sultanganj P.S. Case No.356 of 2019 is hereby rejected. However, the petitioner is directed to surrender before the court below and the learned court below shall dispose of the bail application of the petitioner on the same day without being prejudiced by this order.
