The instant application for regular bail has been filed by the petitioner in connection with Harnaut (Telmar) P.S. Case no. 256 of 2022 instituted for the offence punishable under Section 304(B)/34 of the Indian Penal Code. As per allegation in the FIR, there was love marriage between the petitioner and the sister of the informant. After marriage, petitioner has tortured in various ways to the sister of the informant due to non-fulfillment of Rs. three lac and ultimately they killed her. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is husband of the deceased and has been falsely implicated in this case. In fact, deceased herself

Patna High Court CR. MISC. No.17914 of 2023(3) dt.27-06-2023 2/2 committed suicide because her family members have not invited her in her brother's marriage. He had never demanded any thing from the deceased and her family members. Petitioner has got no criminal antecedent and languishing in custody since 19.08.2022.

Learned APP appearing for the State has opposed the prayer of Bail and submitted that during investigation, several witnesses have supported the prosecution story. As per postmortem report, doctor has opined cause of death due to asphyxia caused by strangulation. Deceased died in her matrimonial home within six months of marriage.

Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.

The trial court is directed to expedite and conclude the trial within a period of six months.
