Petitioner seeks bail in a case registered for the offences punishable under Sections 414,34 of the Indian Penal Code as well as Section 20/22 of the NDPS Act. Submission is that the allegation against the petitioner is that one strip of Ativan medicine was recovered from his possession.
Petitioner is in custody since 11.07.2017, he has got no such type of criminal antecedent, though some other criminal cases are there against the petitioner.
Considering the entire facts, let the petitioner, above named, be released on bail after framing of the charge or completion of two months of custody from today
Patna High Court Cr.Misc. No.57879 of 2017 (5) dt.20-03-2018 whichever is earlier on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with NDPS Case No.16 of 2017 arising out of Barauni Rail P.S.Case No.122 of 2017, G.R.No.149 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
