2. The petitioner seeks bail in a case registered for the offence punishable under Section-366(A) of the Indian Penal Code.
3. Allegedly, the petitioner kidnapped the minor daughter of the informant.
4. At the very outset, drawing my attention towards the statement of the victim recorded under Section 164 of the Cr.P.C., learned counsel for the petitioner has submitted that the victim has stated her age to be 19 years whereas the learned
Patna High Court CR. MISC. No.17559 of 2025(3) dt.13-05-2025 2/2 Magistrate has mentioned her age as 17 years, which shows that she is on the verge of attaining the majority. She did not support the prosecution story rather she has stated that she went with the petitioner out of her own sweet will. The petitioner is languishing in custody since 27-06-2024.
5. Learned APP has opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI, Nawada in connection with Nardiganj P.S. Case No. 175 of 2024.
