JUSTICE SUDHIR SINGH ORAL ORDER 17-07-2015 The petitioner is apprehending his arrest in connection with Case No. 53C3 Ex. Act/2014 for the offences instituted under Section 47(a) of the Excise Act.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 19.11.14 on the basis of confidential information, the informant alongwith other officials and police force raided the Gumati of the petitioner, from where total 41 liters illegal country made liquor and 62 pieces disposal glasses were recovered and the accused petitioner succeeded in fleeing away from there and accordingly, seizure list was prepared.

Patna High Court Cr.Misc. No.26239 of 2015 (2) dt.17-07-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner has been made accused due to mistake of fact. It is further submitted that nothing has been recovered from conscious possession of this petitioner and he has falsely been implicated in the present case due to village politics. It is further submitted that the petitioner has got no criminal antecedent. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Case No. 53C3 Ex. Act/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda at Biharsharif, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
