JUSTICE RAJIV ROY ORAL ORDER 28-07-2022 Heard Mr. Rajeev Ranjan, learned counsel for the petitioner and Miss. Gulnar Begum, learned APP for the State. Pursuant to the last order dated 21.7.2022, a supplementary affidavit has been filed to complete the incomplete narration that was made in para-3 of the bail application, according to which, the petitioner has five criminal cases arising out of the same police station i.e. Gardanibagh Police station and of almost same nature of 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that allegation against him is that of snatching of the mobile in the train. He was apprehended on the spot, the mobile phone was
Patna High Court CR. MISC. No.17519 of 2022(3) dt.28-07-2022 2/3 recovered, he was thrashed, was taken into judicial custody and is in jail since 24.9.2021 (as stated in para-15 of the bail application).
Taking into account the aforesaid fact that the petitioner is in custody since 24.9.2021 and the charge-sheet stands submitted in the matter, this Court is inclined to grant him the privilege of bail but with certain conditions in view of the fact that he has five criminal antecedents of the same nature. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna, in connection with G.R.P. Patna Jn. P.S. Case No. 302 of 2021 subject to the following conditions: (i) one of the bailors should be the family members of the petitioner, who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of bail by the Trial Court itself;
(iii) he shall appear before the concerned police station every fortnight for one year to mark his presence;

No.17519 of 2022(3) dt.28-07-2022 3/3 (iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. With the aforesaid observations, the bail application is allowed.
