JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 341, 323, 354, 379, 385, 34 of the Indian Penal Code.
As per the prosecution case, the accused persons including petitioner assaulted the informant with slaps and fists. Accused persons are also alleged to have torn the cloths of the informant and tried to molest her.
Learned counsel for the petitioner submits that there is land dispute between the parties and on account of that this false and concocted case has been lodged. As a matter of fact, this petitioner has already filed a case vide Kotwali P.S. Case No. 592 of 2022 against the father of the informant and in order to pressurize, this false and concocted case has been lodged. The
Patna High Court CR. MISC. No.16665 of 2023(2) dt.19-05-2023 2/2 petitioner has four cases pending against him and claims that he is on bail in all the four cases.
Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Munger in connection with Kotwali (Purabsarai) P.S.
