The petitioner seeks bail in connection with Sikraul P.S. Case No. 69/2017 dated 07.08.2017 instituted for the offences under Sections 341, 323, 324, 354, 307, 504/34 of the Indian Penal Code.
The petitioner is alleged to have inflicted knife injuries on the person of the informant and his son, Subhankar Pandey. The injuries suffered by the informant have been opined to be simple in nature, whereas the injuries suffered by the son of the informant are grievous and dangerous to life. From the F.I.R., it appears that there was some dispute between the petitioner and the informant over the issue of
Patna High Court Cr.Misc. No.48678 of 2017 (3) dt.03-01-2018 2/2 throwing of garbage in each other's area. A scuffle appears to have taken place for the aforesaid dispute. Though the petitioner is alleged to have given knife blows on the informant and one of his sons, but from the several other circumstances, it appears that the bone of contention lay somewhere else and it was only in a flash of temper that the occurrence has been committed. Taking into account the fact that the petitioner is the neighbour of the informant and the injured and that good relations can only be restored between the neighbours if the petitioner is granted bail, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Sikraul P.S. Case No. 69/2017.
