2. The petitioner has preferred this application for grant of regular bail in connection with Obra P.S. Case No. 512 of 2024, dated 11.12.2024, registered for the offences punishable under Sections 318(4), 338, 336(3) and 308(5) of the B.N.S., 2023 read with Section 3(5) of the B.N.S., 2023.
3. As per the prosecution case, during the course of vehicle checking, the informant received confidential information regarding extortion of money from vehicles by showing fake and counterfeit receipts near village Aranda. It is further alleged that when the informant along with police personnel reached the alleged place, on seeing the police two
Patna High Court CR. MISC. No.15985 of 2025(2) dt.21-04-2025 2/3 persons managed to flee while one person was apprehended and during search, one booklet of receipts mentioning 'In The Direction of Transport Ministry of India' was seized from the pocket of apprehended accused (petitioner).
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case merely on the basis of suspicion. There is general and omnibus allegation against the petitioner. No money was recovered from the conscious possession of the petitioner. The co-accused persons namely, Sudhir Kumar and Lav Kush Kumar have already been granted bail by a Co-ordinate Bench vide order dated 16.04.2025 passed in Cr. Misc. No. 15817 of 2025. The petitioner has one criminal antecedent as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 12.12.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as petitioner's period of custody, the petitioner, above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.15985 of 2025(2) dt.21-04-2025 3/3 satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, in connection with Obra P.S. Case No. 512 of 2024.
7. The application stands allowed.
