That the present writ application is for issuance of writ in the nature of writ of mandamus directing the respondents to remove the illegal encroachment over the ancestral land of the Petitioner appertaining to old khesra No. 1290 & 1340 and New Khesra No. 1918, Khata No. 52 area 94 decimals of Land. The above mentioned plots stands recorded in the name of the great grandfather of the petitioner in the year 1935

Patna High Court CWJC No.8116 of 2016(2) dt.28-03-2023 2/2 and since then they have been coming uninterrupted, and peaceful possession over the land in question and now the respondents have illegally encroached upon the petitioner's land constructed the Anganwari centre, Sub-Primary health centre, fixed the electric wire and also constructing the road in spite of availability of Govt. land pass such other order or orders, Direction or Directions as your lordships may deem fit and proper in the interest of Justice."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
