The petitioner seeks regular bail in Barh P.S. Case No.107 of 2016 registered for the offence under Sections 302, 120(B)/34 of the I.P.C.
Allegation against the petitioner including five other accused persons is of firing on the deceased causing his death. Submission of the learned counsel for the petitioner is that second fire was shot at the deceased by this petitioner. He is a thela puller and he is in custody since 4.6.2016. From perusal Heard learned A.P.P. also who opposed the prayer for bail on the ground that the trial has commenced and two witnesses have been examined who have also named this petitioner.
Patna High Court Cr.Misc. No.49331 of 2017 (3) dt.09-11-2017 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner However, considering that the trial has commenced, the trial court is directed to expedite the trial and try to conclude it within a period of 7 months on the basis of materials available on the record.
