====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 09-09-2024 Heard learned counsel for the petitioner and learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Chaori P.S. Case No. 47 of 2016 dated 25.05.2016 registered for the offences punishable u/s 302 & 201 of the Indian Penal Code.

3. As per the prosecution case, the informant, S.I., Shatrughan Paswan of Chaori police station stated that while he was on patrolling, he got an information that a dead body of an unknown girl aged about 18 years was lying in the village Berath Jokatiya Dham who wore parrot green colored cloth, fair in color, having height 5 feet and her death was caused by

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The F.I.R. has been lodged against the unknown persons. The petitioner is not named in the F.I.R. It is next submitted that no witness has been examined till date. There is a delay at the stage of prosecution witness. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 07.06.2022.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur at Ara in connection with Chauri P.S. Case No. 47 of 2016with the condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable
