The petitioner seeks bail in connection with Barari (Semapur) P.S. Case no. 172 of 2017 registered for the offence punishable under Sections 302, 120-B/34 of the Indian Penal Code and under Section 27 of the Arms Act.

The petitioner along with other accused persons are said to have committed murder of the son of the informant by hired killers to grab the money.

It is submitted by the learned counsel for the petitioner that he has no concern with the business of the deceased. As a matter of fact, the petitioner is a teacher in the school where wife of the informant is also headmistress and petitioner had debunked the defalcation made by wife of the

Patna High Court Cr.Misc. No.50504 of 2017 (2) dt.30-10-2017 2/2 informant. Due to the aforesaid grudge, the informant has falsely implicated the petitioner in the case. The allegation levelled against the petitioner is not specific rather omnibus. He does not happen to be the assailant. He is 60 % handicapped by both the legs. The petitioner has been languishing in custody since 1.9.2017.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Barari (Semapur) P.S. Case no. 172 of 2017.
