JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Section 376 of the Indian Penal Code. It is alleged by the informant that seven months ago the petitioner entered in her house seeing her alone and committed rape with her and when she tried to raise alarm the petitioner pressed her mouth by putting her dupatta.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It has also been submitted that the petitioner has denied any physical relationship with the informant. There is no substantive evidence to support the contention of the informant. Petitioner has falsely been implicated in the present case.

Patna High Court Cr.Misc. No.25684 of 2015 (3) dt.22-09-2015 It has been submitted on behalf of the State that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Samastipur in connection with Mahila (Samastipur) P.S.Case No.07 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
