JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Barun P.S. Case No. 138 of 2017 registered under Sections 379, 411, 420 and 120B of the Indian Penal Code, Section 3/4/5 of the Bihar Illegal Mines Act and Sections 33/41/42 of the Indian Forest Act. Petitioner was apprehended while transporting stone chips from Kanvandia to NTPC Khaira by truck. It is submitted by learned counsel for the petitioner that the petitioner happens to be the driver of the aforesaid truck and he was transporting the stone chips on the basis of the challan issued by Mines Department, Gaya and produced the said challan to the police officer. He has no concern with the aforesaid stone chips. He has been languishing in custody since 25.08.2017.

No.50309 of 2017 (2) dt.17-10-2017 2/2 Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 138 of 2017.
