Petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. A stolen motorcycle was allegedly recovered from possession of the petitioner, though the said motorcycle was not a stolen property of the present case. Petitioner is in custody since 25.04.2018 after remand from some other case. Submission is that other co-accused have been allowed bail by different Coordinate Benches of this Court vide Annexure-2 series.

Considering the aforesaid facts as well as completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees

Patna High Court Cr.Misc. No.37739 of 2018 (2) dt.10-07-2018 2/2 Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gardanibagh Police Station Case No. 178 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
