JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-07-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Runisaidpur P.S. Case No. 315 of 2014 registered for the offence under Sections-307, 506 & other minor sections of the Indian Penal Code.

It is alleged that petitioners mercilessly assaulted the informant.

Learned counsel for the petitioners points out that the niece of informant solemnized her marriage with son of petitioner No. 1 by her own sweet will but the father of the girl lodged Runisaidpur P.S. Case No. 212 of 2014 against petitioners

Patna High Court Cr.Misc. No.24627 of 2015 (2) dt.14-07-2015 2/2 and when the statement of girl was recorded u/S 164 of the Cr. P.C. in the above-stated case, she did not support the case of informant of the aforesaid case. It is further pointed out on behalf of petitioners that being annoyed with the above-said development, the informant of the present case and his associates committed murder of wife of petitioner No. 1 for which, Runisaidpur P.S. Case No. 501 of 2014 was registered. It is further contended by him that moreover, the informant of the present case, is said to have sustained only one injury which has been found simple in nature, said to be caused by hard and blunt substance.

Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Runisaidpur P.S. Case No. 315 of 2014 to the satisfaction of Chief Judicial Magistrate, Sitamarhi subject to conditions as laid down u/S 438(2) of the Cr. P.C. (Hemant Kumar Srivastava, J) A.K.V./- U T
