ANJANA MISHRA ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 26.07.2017 in connection with Begusarai Muffasil P.S. Case No.78 of 2015 registered for the offence under Section 302/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the dispute was between the deceased and one Kailu Mahto and not against this petitioner. However, on account of the fact that the petitioner and Kailu Mahto had inimical terms, the names of the petitioner and his mother have been brought in connection with the present case. Learned counsel for the petitioner further submits that the mother of the petitioner has been granted regular bail, vide order dated 06.10.2016, passed
Patna High Court Cr.Misc. No.51892 of 2017 (2) dt.09-11-2017 2/2 in Cr.Misc. No.44521 of 2016.
Considering the nature of allegations and that the petitioner is a man of clean antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Raghuveer Prasad, Judicial Magistrate, 1st Class, Begusarai, in connection with Begusarai Muffasil P.S. Case No.78 of 2015.
