JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 379 and 411/34 of the Indian Penal Code.
The informant's case is that some unknown culprits were taking away his she-buffalo when he raised alarm when the co villagers caught one Anil Sah who disclosed the names of other associates including the petitioners.
It is submitted by the learned counsel for the petitioners that there is nothing on record to suggest the complicity of the
Patna High Court Cr.Misc. No.24653 of 2015 (3) dt.21-07-2015 2/2 petitioners in the commission of offence. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Rohtas at Sasaram in connection with Sasaram (Mufassil) P.S. Case No. 370 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. The learned court below shall be at liberty to cancel the bail bonds of the petitioners in case the petitioners do not cooperate in the investigation if it has already not been concluded.
