The petitioner has filed the instant application for grant of regular bail in connection with Kishanganj P.S. Case no. 595 of 2019 registered for offence under sections 25(1-B)(a) and 26 of the Arms Act.

As per allegation in the F.I.R., on seeing the police personnel, two persons started to flee. While one of them was successful, the other person was caught along with his motorcycle. He disclosed his name as Md Faizan Mustafa, the petitioner herein. A semi automatic pistol is stated to have been recovered from his waist.

It is submitted by learned counsel for the petitioner that the allegations as leveled in the F.I.R. are false and concocted.

Patna High Court CR. MISC. No.15059 of 2020(3) dt.01-06-2020 2/2 The petitioner is a 19 years old brilliant student and has been falsely implicated by his near relatives over dispute of retiral dues of his deceased father. The petitioner is in custody since 16.12.2019.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the above facts including the petitioner being in custody since 16.12.2019, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Kishanganj P.S. Case no. 595 of 2019 on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj.
