This application is for grant of regular bail in connection with Barbigha (Keoti O.P.) P.S.Case No.11 of 2019 dated 12.1.2019 for the offences under Section 135 of the Electricity Act.

Allegation against the petitioner is of commission of energy theft for running Paultry Farm and causing loss of Rs.47,504/- to the state exchequer.

Submission of the learned counsel for the petitioner is that Paulty Farm is not of the petitioner and he has falsely been implicated in this case, however, after some argument, it is submitted that he will pay the amount if some

Heard learned A.P.P. and the learned counsel for the South Bihar Power distribution Co. Ltd.

In such view of the matter, the petitioner is directed to surrender within a period of four weeks from the date of receipt of the order with a bank draft of Rs.7,504/- in fovour of South Bihar Power distribution Co. Ltd. and if the same is filed, he will be released on provisional bail in connection with Barbigha (Keoti O.P.) P.S.Case No.11 of 2019 dated 12.1.2019 for a period of four months and during that period, he has to pay rest of the amount in four equal installments in the first week of each month.

It is made clear that once the total amount is paid, his bail bond shall be confirmed and the payment shall be subject to result of the final adjudication of the case and it is also made clear that failure to make payment of any installment, his bail bond shall be cancelled.
