Mr. Dilip Kumar No. 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 22-08-2022 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 406, 420 of the Indian Penal Code.

As per FIR, Rs. 10,00,000/- was transferred in the account of the petitioners but according to the estimate amount they did not complete the work and misappropriated the government money.

It is submitted by learned counsel for the petitioners that petitioners are innocent and have been falsely implicated in this case. He submits that the petitioners are ready to deposit Rs. 10,00,000/- in the treasury in 4 installments. Out of four installments, first installment i.e. Rs. 2,50,000/- will be

Rest amount shall be paid by them in three equal installments within six months from today. He submits that petitioners have no criminal antecedent as stated in para-3 of the bail application. Considering the facts and circumstances of the case, let the above named petitioners in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on provisional bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kargahar P.S. Case No. 72 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.

On payment of entire amount, the provisional bail of the petitioner will be confirmed by the learned court below. (Anjani Kumar Sharan, J) devendra/- U T
