JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-06-2019 The anticipatory bail application filed on behalf of petitioner No.1, namely, Rohit Kumar @ Rohit Singh has already been rejected vide order No.2, dated 26.03.2019. Heard learned counsel for the petitioner No.2, namely, Sandhir Singh and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Begusarai Muffasil P.S. Case no. 740 of 2018, registered under Sections 401, 414, 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

The accusation is that on receiving secret information about keeping the stolen Bolero vehicle absconding accused Rohit Kumar of Balia P.S. Case No. 284 of

Patna High Court CR. MISC. No.16273 of 2019(4) dt.19-06-2019 2/2 2018 and Muffasil Lakho P.S. Case No. 504 of 2018, the informant and other Police personnel reached there then two persons sitting on bolero vehicle succeeded to flee away. The local Chowkidar identified them as Rohit Kumar and Sandhir Singh (petitioner).

Learned counsel for the petitioners submits that it would appear from the F.I.R. that petitioner has not been apprehended by the Police on the spot, rather, his name has been surfaced on the basis of information of local Chowkidar. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, namely, Sandhir Singh, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-II-cum-Special Judge, Begusarai in connection with Begusarai Muffasil P.S. Case No. 740 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
