The petitioner apprehends his arrest in Ara Town P.S. case No. 455 of 2017 for the offences punishable under Section 406, 420 of the Indian Penal Code and under Section 138 of the N. I. Act.
The learned counsel for the petitioner submits that petitioner took money from the informant but he returned most of the amounts. The petitioner issued two cheques one of Rs. two lac on 06.04.2017 and another of Rs. two lac on 18.04.2017 but both the cheques were dishonoured. The learned counsel for the petitioner submits that petitioner is ready to return the amount within four months.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.56742 of 2017 (2) dt.14-12-2017 2/2 allegation made against the petitioner and the fact that petitioner is ready to return the amount within four months, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town P.S. case No. 455 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
The petitioner shall pay Rs. four lac to the informant within four months through demand draft or RTGS and if the petitioner fails to deposit the amount in the account of informant within four months the learned court below shall cancel the bail bonds of the petitioner immediately thereafter.
